Others may offer their own products and services through our Services, and we aren’t responsible for those third-party activities. By using the Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. Locumsbook generally does not review content provided by our Members or others. You agree that we are not responsible for others’ (including other Members’) content or information. We cannot always prevent this misuse of our Services, and you agree that we are not responsible for any such misuse. You also acknowledge the risk that you or your organization may be mistakenly associated with content about others when we let connections know you or your organization were mentioned in the news. Members have choices about this feature (eg, medicine transfer which is by no means a touting feature but a transfer of medicines about to expire or which are not being utilized by an institution to other centers that use the medicines through a bidding system. It may be subject to tax regulations.)

Locumsbook helps connect Members offering their services (locuming) with Members seeking services (employers). Locumsbook does not perform nor employs individuals to perform these services. You must be at least 18 years of age to offer, perform or procure these services. You acknowledge that Locumsbook does not supervise, direct, control or monitor Members in the performance of these services and agree that (1) Locumsbook is not responsible for the offering, performance or procurement of these services, (2) Locumsbook does not endorse any particular Member’s offered services, and (3) nothing shall create an employment, agency, or joint venture relationship between Locumsbook and any Member offering services. If you are a Member offering services, you represent and warrant that you have all the required licenses and will provide services consistent with the relevant profession.

Similarly, Locumsbook may help you register for and/or attend events organized by Members and connect with other Members who are attendees at such events. You agree that (1) Locumsbook is not responsible for the conduct of any of the Members or other attendees at such events, (2) Locumsbook does not endorse any particular event listed on our Services, (3) Locumsbook does not review and/or vet any of these events, and (4) that you will adhere to these terms and conditions that apply to such events.

You agree that Locumsbook may reject or remove any Job post or any questions for Job applicants for any or no reason. For example, Locumsbook may remove any Job post or question that directly or indirectly discriminates against Job applicants. Direct discrimination means, for example, that a Job post, requirement, or question specifically makes clear that only Job Seekers matching a certain criteria are wanted, thereby excluding others because of, for example, their gender, race, age or disability. Indirect discrimination means, for example, that a Job post, requirement, or question implicitly excludes certain classes of Job Seekers by making it impossible for them to qualify for the job requirements. You understand and agree that it is your responsibility to refrain from posting any Job, requirement, or question that directly or indirectly discriminates against Job Seekers or otherwise violates applicable law. You understand and agree that you are responsible for ensuring that your Job post requirements and criteria are job-related and in compliance with applicable law. Locumsbook does not guarantee delivery, your receipt of the Job applicants’s notifications or application materials, or that there will be no mistakes in the transmission or storage of the data. You are solely responsible for checking your Employer dashboard on the chatbot and web to view job applications and other information. Any other notifications, such as emails, you may receive about applications or other activities, are provided solely as a courtesy to you and you should not rely on them.

In the event a message being sent is intended for a closed account, these messages will not be deliverable. If you do not feel comfortable sending a message, such as an offer letter, to a Job applicant through Locumsbook’s functions, do not use the Locumsbook’s functions and please contact the Job Seeker via another method. When using the Locumsbook platform, Locumsbook will attempt to send applications to the contact information provided to Locumsbook by you, however, Locumsbook has no ability to verify the contact information provided by you. In the event you provide incorrect contact information, it shall be your responsibility to correct, appropriately respond, or take any steps necessary to protect the privacy of Job applicants, and you indemnify Locumsbook for any damages resulting therefrom.

It is ultimately the Employer’s responsibility to confirm whether any interviews were scheduled, or to reschedule or cancel interviews if necessary. The decision of who to interview is decided solely by the Employer, who can choose to interview any Job Seeker at any time, and by scheduling such interviews, Locumsbook does not warrant that a Job Seeker is qualified, meets the criteria the Employer has set, or that the information provided by the Job Seeker to Locumsbook is accurate. Locumsbook candidate management tools are intended to allow Employers to more efficiently connect with Job Seekers as they determine, and the sole responsibility for the content of any screening information, any decision to proceed or not proceed with interview or offers, any issues arising from an acceptance or denial of employment, and any other issues arising from the use of candidate management tools is solely with the Employer. By using this and other candidate management tools, you acknowledge and agree that Locumsbook is not procuring employees for Employers or procuring opportunities to work for Job Seekers, and that Locumsbook does not act as your employment agency by offering these candidate management tools.

When you view, send, take action on, make a decision regarding, store, or receive materials (including Job posts, resumes, applications and messages) through or using the platform Locumsbook may, for any purpose, use any data of such materials or action for data analysis, quality control, or to refine the Site or any other Locumsbook product or service (including to provide better search results and other Job Posts for Job Seekers and Employers), whether via automated means or otherwise. Locumsbook may also inform the Job Seeker of your actions or activity related to such materials through or using the platform. For example, Locumsbook may notify the Job Seeker about your activity or action related to a Job Ad (such as pausing or closing it), or Job Seeker’s application or Resume (for example, that you viewed or responded to it, or that you made a decision with respect to it). You hereby consent to Locumsbook informing the Job Seeker about such actions and activities.

3.4 Limits

We have the right to limit how you connect and interact on our Services. Locumsbook reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other Members. Locumsbook reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Services (e.g., violating any of the Dos and Don’ts).

3.5 Intellectual Property Rights

We’re providing you notice about our intellectual property rights. Locumsbook reserves all of its intellectual property rights in the Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. Locumsbook logos and other Locumsbook trademarks, service marks, graphics and logos used for our Services are trademarks or registered trademarks of Locumsbook.

3.6 Automated Processing

We use data and information about you to make relevant suggestions to you and others. We use the information and data that you provide and that we have about Members to make recommendations for connections, content and features that may be useful to you. For example, we use data and information about you to recommend locum jobs to you and you to employers. Keeping your profile accurate and up to date helps us to make these recommendations more accurate and relevant.

3.7 Locumsbook Ads Program Terms

You use the Ads Program when you advertise with Locumsbook by posting, providing, submitting, using, editing, claiming, or paying for any advertisement (“Ad”) for publication on or through Locumsbook. Ads may be posted directly via the platforms. By posting Ads and using the Ads Program, you agree to Locumsbook terms of service(the “Agreement”), including these Locumsbook Ads Program Terms (“LAP Terms”). Locumsbook may update the Ads Program or these LAP Terms at any time without liability, and your use of the Ads Program after notice that these LAP Terms have changed indicates acceptance of the updated LAP Terms.

Ad Publishing

Ads may promote job posting of open employment positions (“Jobs” or “Job Ads”), hiring events or job fairs, both online or in-person, or an Employer’s workplace generally. Ads are User Content under the Agreement, and you are granting Locumsbook, its affiliates, and sublicensees a license to use your Ads and associated data, and to display, publish, reformat, display a snippet or portion of, and host (but not change the content of) your Ads in any way Locumsbook or its affiliates or sublicensees see fit, including due to technical limitations.

Ads may appear on any page, content, service, device, screen, app, or property chosen by Locumsbook in its sole discretion, whether provided by Locumsbook as part of the Locumsbook platforms, or provided by a third party (“Other Sites”). Locumsbook has limited control over Other Sites, including their nature, content, appearance, and Ad display, and you accept any related risks of publication. Other Sites may collect or receive performance information about your Ad.

Target audience membership is based partly on information and criteria provided by the Employer, for example information provided in the Ad, but the composition of each target audience on the platforms, and the frequency of publication to that audience, are determined by Locumsbook in its sole discretion. Locumsbook may have limited or no control over the display of Ads on Other Sites, including their audiences. From time to time Locumsbook may add labels (such as “Urgent”, “Urgently Hiring”, “Ad”, “Paid”, “Promoted”, or “Sponsored”) when publishing an Ad. Locumsbook reserves the right to add, change, or remove labels at any time. Locumsbook may display an estimate of the compensation associated with any Job Ad. If you do not want an estimate to be shown, you must provide Locumsbook with the actual compensation.

Locumsbook does not guarantee reach, performance, placement, or distribution of Ads, all of which may vary depending on Locumsbook’s consideration of various factors, such as supply and demand, industry, type of role, and sponsorship. The distribution, placement, positioning, size, and location of Ads are determined by Locumsbook in its sole discretion. You agree that Locumsbook has no obligation to accept, host, or publish your Ad. That decision is entirely Locumsbook’s in its sole discretion. Locumsbook may reject or remove any Ad for any or no reason without notice. Locumsbook may also pause Ad campaigns without notice. For examples of why Job Ads from Employers may be rejected, refer to Locumsbook Job Posting clauses.

Locumsbook further reserves the right to include or reject any or all Job Ads from a job board. Generally, job boards may only post Job Ads on their own behalf as an Employer. A job board may only post Job Ads on its clients’ behalf. Attempts to violate the Guidelines may result in limiting or disabling your account. The determination as to whether you are a job board is made by Locumsbook in its sole discretion, and such decision is binding. Locumsbook further reserves the right to reject any Job Ads which advertise staffing opportunities or platforms rather than jobs.You acknowledge that inclusion of Ads that violate these LAP Terms or Locumsbook policies or standards may harm Locumsbook and its users. Although Locumsbook may indicate why an Ad has been removed, we cannot give every reason why, and we always retain the right to remove any Ad if we feel it is in the interest of users or Locumsbook. The Locumsbook team responsible for maintaining the quality of the Site is independent, and its decisions are final and not subject to review.

Please note that Locumsbook will require an Ad to be sponsored, or limit the number of free Ads you are allowed to post, for any or no reason in Locumsbook’s sole discretion, including to benefit Job Seekers, to verify the legitimacy of the Ad or the Employer, to prevent abuse of the free to post system, or to improve the platforms. For example, sponsorship may be required for identical jobs posted in multiple locations, jobs re-posted after an initial time period, jobs that have reached the free Ad time limit on the platforms, jobs posted with a confidential or generic company name, jobs that are commission-only, hard-to-fill jobs, or jobs posted by a staffing agency, recruitment process outsourcer, or other recruitment-based company. Locumsbook Hiring Events may also require a minimum Ad budget.

Performance, cost, budget, and other data related to your unclaimed indexed Job Ad on the Site is available to anyone who claims the Job Ad or feed. It is your responsibility to claim your Job Ads and feeds, and to alert Locumsbook in case of an inaccuracy.

For Locumsbook Hiring Events: When you post a Locumsbook Hiring Event, you are asking Locumsbook to manage the Ad campaign, distributing its budget among our different pricing models in our sole discretion. You will be charged in accordance with the selected pricing model(s) and any applicable subscription fee. Posting an Locumsbook Hiring Event may require a minimum advertising budget. You are also asking Locumsbook to send emails or text messages related to your listing to users who RSVP to your listing event, such as in case of event cancellation, though delivery is not guaranteed. You are solely responsible for all aspects of your hiring event, whether participating or responding, including your Ad and hiring process, the advert’s timing exclusive to Locumsbook, location, and attendance, signage, documentation, reviewing Job Seeker qualifications, verifying information, screening applicants, and responding to other requests.

Ad Sponsorship

An Ad can be sponsored using tools on the platforms, or through a campaign, including Sponsored Jobs. “Sponsor” means you are paying Locumsbook to advertise and publish the Ad, and you are requesting that Locumsbook manage your Ad campaign using automated tools for Ad placement and bid optimization, for exposure and visibility on the platforms. This management is in Locumsbook’s sole discretion and is provided without warranty as to placement or visibility of any Ad. Sponsorship is not a guarantee that the Ad will be published at any particular time or place, or displayed more prominently or frequently than other Ads. Sponsorship means Locumsbook exercising its judgment and discretion in publishing the Ad, to achieve what Locumsbook determines is the most appropriate visibility for the Ad and budget.

The price to sponsor an Ad is measured by user activity, such as impressions, clicks, Started RSVPs, RSVPS, or Started Applications. You are not buying these clicks or other actions themselves; they are only different ways to measure the advertising service Locumsbook provides. Prices vary based on many factors, including supply and demand of Ads, impressions, clicks, Started RSVPs, RSVPs, Started Applications, Applications, internet traffic, time of day or year, job title, and job location.Charges are solely based on Locumsbook’s measurements of user activity, including impressions, clicks, Started RSVPs, RSVPs or Started Applications. Locumsbook’s measurements of such activity shall be binding. I Locumsbook’s measurements may include and rely on data from third parties, including vendors and Other Sites, over which Locumsbook has limited control or knowledge.

You agree that Locumsbook has no obligation to accept, host, or publish your Ad. That decision is entirely Locumsbook’s in its sole discretion, regardless of sponsorship. Locumsbook may reject or remove any Ad for any or no reason without notice. Once removed, an Ad does not receive impressions, clicks, Started RSVPs, RSVPs, Started Applications, or Applications.

Budget and Pricing Models

Ad campaigns can be sponsored under different pricing models. Each sponsored Ad will incur a charge upon the associated user action, until its budget is depleted or you pause or close the Ad. For example, one Job Ad campaign may be charged per click/ daily budget, while another campaign may be charged per Started Application. This activity may happen on the Locumsbook platforms. Pricing is indicated on the platforms. When you start, edit, or change a sponsored Job Ad campaign or plan, the pricing models available to you may vary. Locumsbook reserves the right to offer different pricing models at different times in different circumstances, in limited quantities, in limited locations, and for a limited time, or to set any pricing model as default. Prices and pricing models may vary between different Ads, or between the same Ad posted at different times or locations (such as when a campaign is closed and later reopened). If you do not select a pricing model for a sponsored Ad campaign, Locumsbook may select one.

It is your responsibility to monitor your Ad campaigns, select the appropriate pricing model and budget for each campaign, and manage their budgets. You can pause, unpause, or close your Ad campaign at any time. A budget or spending limit you set for one Ad campaign is for that type of campaign only, and does not limit how much you will spend on other campaigns or other services. For example, the budget and limits for Pay Per Started Application campaigns will not apply to a Pay Per Click campaign. If your Order does not contain an end date, your campaign will run, and you will continue to be billed, until you contact Locumsbook to cancel. Locumsbook may provide budget recommendations and performance estimates for a given budget (such as expected visibility or clicks), or other predictions related to your Ad. This data is provided “as is,” without warranty, and does not guarantee performance or visibility, or interaction with your Ad or job.

Pricing Models

Pay Per Impression. You will be charged based on impression count. An impression generally occurs when your Ad appears on a page or screen which has been presented to a user. Delivery of an impression does not guarantee any level of viewership of your Ad or interaction with your job. Impression data may rely on third parties like Other Sites, who may measure impressions differently from each other. Charges are solely based on Locumsbook’s impression measurements. Locumsbook’s impression count shall be binding. Pay Per Click, also known as Daily Budget. You will be charged based on click count. Clicks can be on Ads or on other content such as messages and notifications. Your dashboard will reflect the total click count. Charges are solely based on Locumsbook’s click count. Locumsbook’s click count shall be binding.

Pay Per Started RSVP. You will be charged when a user takes the first step to RSVP to your Hiring Event (a “Started RSVP”), including clicking on a button or link to start or continue an RSVP. A Started RSVP is considered complete even if the user does not proceed further, and does not guarantee they will complete an RSVP or attend a Hiring Event. Charges are solely based on Locumsbook’s Started RSVP measurements. Locumsbook’s Started RSVP count shall be binding. Pay Per RSVP. You will be charged for each RSVP to your Hiring Event. An RSVP is defined as a user completing the online RSVP form agreeing to attend your Event. An RSVP does not guarantee that a Job Seeker will attend your Event. Charges are solely based on Locumsbook’s RSVP measurements. Locumsbook’s RSVP count shall be binding.

Pay Per Started Application. You will be charged when a user takes the first step of applying to your job (a “Started Application”). A Started Application includes: 1) a click on a button or link to start or continue an application; 2) interacting with a chatbot, QR code, or other method to start or continue an application; and 3) a click on a button or link to schedule an interview. A Started Application is considered complete even if the user does not proceed further, and does not guarantee they will complete an application. Charges are solely based on Locumsbook’s Started Application measurements. Locumsbook’s Started Application count shall be binding.

Billing and Payment for Ads

Locumsbook may charge the debit card, or bank account information on file for your account. You will be charged upon the earlier of your Ad campaign spending $2.00 or more. If you previously sponsored Pay Per Click/ Daily budget Ads on the same account, you may also be charged once your Job Ad campaign spends $2.00. For an Ad campaign, or the purchase of products or services of more than $8 per month, you may be charged multiple times a month. If you do not provide a payment method for a Sponsored Job campaign, the campaign will not begin and your Ad will not be visible. Invoices may be provided to you via electronic mail or as communicated by Locumsbook to suit client preference. Your payment must be in accordance with the Payment policies aforementioned in the Agreement. You waive all claims relating to charges unless claimed within 90 days after the charge. You are responsible for paying all expenses and attorney fees Locumsbook incurs collecting late amounts. Refunds (if any) are in accordance with the Refunds section of the Agreement. If you are removed from Locumsbook, but have previously spent on Locumsbook, you are not entitled to a refund of previously spent amounts.

Charges are exclusive of all taxes, including VAT. You are responsible for all taxes and government charges as applicable and appropriate. All withholding tax remittances to the government are your sole responsibility and Locumsbook shall have no liability whatsoever therefor. Your debit card, bank account, and related billing and payment information may be shared by Locumsbook with companies who work on Locumsbook’s behalf, such as payment processors or debit agencies, for the purposes of checking debit, effecting payment to Locumsbook, and servicing your account. Locumsbook may also provide information in response to valid legal process, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims. Locumsbook shall not be liable for any use or disclosure of such information.

Conditions and Prohibited Uses

Your use of the Ads Program is permitted on the condition that you adhere to all applicable Locumsbook terms and policies, including these LAP Terms, the Agreement, the Platforms Rules, Privacy Policy, and instructions on the Platforms. Violation may result in restrictions on your account, termination of your account and the Agreement, and legal penalties and consequences. Locumsbook terms and policies may be modified at any time.

You are responsible for all information you provide or request that Locumsbook publishes, whether through the platforms or otherwise, and whether generated by or for you, in any medium, including text, image, mark, logo, video, or audio, all which is considered User Content under the Agreement. Locumsbook relies on the accuracy of the information you provide. You must notify Locumsbook immediately if you notice any inaccuracy. You accept sole responsibility for: (a) User Content provided by, attributable to, or associated with you, including Ad content, job descriptions, and target URLs; (b) websites reachable from target URLs or your Ad; and (c) ensuring that your use of the Ads Program, the Platforms are lawful and will not cause Locumsbook to violate any applicable law. Locumsbook’s publication of your Ad, or reformatting or addition of labels during publication (such as “Powered by Locumsbook”) does not alter your responsibility.

You represent and warrant that: (i) you have the right and authority to use the Program, including to provide or claim your Ads and job feed; (ii) all information you provide (through the Platforms or otherwise) is true, correct, and current and not misguided or misinformed; (iii) you hold and grant Locumsbook, its affiliates, and sublicensees all rights to use, copy, distribute, and display your User Content; and (iv) such use and websites linked from your Ads will not violate or encourage violation of any applicable law. You shall not cause, authorize, or contribute to: (1) automated, fraudulent or otherwise invalid Platforms activity such as impressions, clicks, Started RSVPs, RSVPs, Started Applications, or Applications; (2) manipulation of Ad placement, bidding, or any other part of the Platforms; (3) inaccurate reporting of any measurements of user activity including applications; (4) circumventing charges you owe to Locumsbook, such as by preventing the reporting of an application; (5) advertisement of goods or services through Locumsbook; or (6) anything unlawful or fraudulent. Locumsbook reserves the right in its sole discretion to terminate accounts suspected of such activity without notice, and to take corresponding legal action.

Locumsbook may choose not to accept any Ads for any or no reason. Locumsbook further reserves the right to disable or terminate any Employer’s account, for any or no reason, without notice. Although Locumsbook may provide information related to our decision-making process, we cannot give every reason why an account may be terminated or an Ad may be removed. The Locumsbook team responsible for maintaining the quality of the Site is independent, and its decisions are final and not subject to review.

Ads Disclaimer and Limitation of Liability

THE ADS PROGRAM, THE PLATFORMS (WEBSITE AND APPS) ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. LOCUMSBOOK AND ITS AFFILIATES, AND ITS SUBLINCEES AND THEIR LICENSORS, DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION FOR TITLE, NON-INFRINGEMENT, SERVICE QUALITY, MERCHANTABILITY, AND FITNESS FOR ANY PURPOSE. YOU USE THE ADS PROGRAM, THE PLATFORMS AT YOUR OWN RISK. LOCUMSBOOK DOES NOT GUARANTEE THAT THE ADS PROGRAM, THE PLATFORMS WILL ALWAYS BE UNINTERRUPTED, ERROR FREE, SAFE, OR SECURE. LOCUMSBOOK DISCLAIMS ALL LIABILITY WITH REGARD TO OTHER SITES.

Locumsbook and its affiliates, and its sublicensees and their licensors, disclaim all guarantees regarding positioning, accuracy, or the levels or timing of: (a) costs of advertising, whether measured by impressions, clicks, Started RSVPs, RSVPS, Started Applications, Applications, or otherwise; (b) delivery or rates of impressions, clicks, Started RSVPs, RSVPS, Started Applications, or Applications (including any estimates on the Site or an Order); (c) reach, performance, placement, distribution, or conversion of Ads; (d) accuracy or success of Ad targeting or the size or composition of any audience, or the ability or inability of any person to view an Ad; (e) the interest level or qualification of anyone who interacts with your Ad, Hiring Event, or job; and (f) attendance at a job interview, Hiring Event, or job.

CLICKS AND OTHER USER ACTIVITY ARE ANONYMOUS, AND LOCUMSBOOK HAS NO RESPONSIBILITY FOR CONFIRMING A USER’S IDENTITY. USER ACTIVITY SUCH AS AN IMPRESSION, CLICK, STARTED RSVP, RSVP, STARTED APPLICATION, OR APPLICATION IS NOT A GUARANTEE OF INTEREST IN YOUR AD OR JOB. LOCUMSBOOK IS NOT RESPONSIBLE FOR CLICK FRAUD, FRAUDULENT LEADS, TECHNOLOGICAL ISSUES, OR OTHER POTENTIALLY INVALID ACTIVITY BY THIRD PARTIES THAT MAY AFFECT THE COST OF ADS.

EXCEPT FOR AMOUNTS PAYABLE PURSUANT TO HEREUNDER, AND FOR ANY BREACH BY YOU OF SECTIONS AFOREMENTION TO THE FULLEST EXTENT PERMITTED BY LAW: (i) NEITHER PARTY WILL BE LIABLE UNDER THESE LAP TERMS FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES WHETHER IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY; AND (ii) EACH PARTY’S AGGREGATE LIABILITY TO THE OTHER UNDER THESE LAP TERMS IS LIMITED TO AMOUNTS PAID OR PAYABLE TO LOCUMSBOOK BY YOU FOR THE ADS GIVING RISE TO THE CLAIM.

Cancellation

You may cancel an Ad or campaign at any time. Cancellation is generally effective within 24 hours. You are responsible to pay for all advertising prior to cancellation, as well as any agreed-upon platform fee. Locumsbook may notify Job Seekers if you cancel a Hiring Event or sponsored Ad. Locumsbook may cancel or terminate the Ads Program or these LAP Terms at any time. Sections 5, 6 and 8 will survive any expiration, cancellation, or termination of these LAP Terms

Indemnification

You shall indemnify, defend and hold harmless Locumsbook, its agents, affiliates, licensors, partners, and publishers (including Other Sites) from any claim or liability (including legal fees) arising out of your Ads Program use, Ads, User Content, screening or screener questions, Hiring Event, use of the Platforms, any information or data you provide, your hiring process, or breach of the Agreement or these LAP Terms.

Demographic survey

When Job Seekers apply or RSVP to your job posting, Locumsbook may give them the opportunity to provide certain demographic information, such as race and ethnicity, gender, age, and disability status etc (“demographic data”). This Locumsbook demographic data survey is separate from any voluntary self-identification questions provided by Employers. By using the Program, you agree that Locumsbook may collect demographic data from Job Seekers applying to your job listing using Locumsbook’s demographic survey, and that Locumsbook may use the information from that survey to evaluate and improve our products. You further agree that you as an Employer have no ability, right, or entitlement to view or access demographic data collected via the Locumsbook demographic data survey pertaining to any Job Seeker or related to any employer by any means including civil discovery, subpoena, or any other legal process without their permission. You agree you are solely responsible for complying with applicable non-discrimination laws. Locumsbook disclaims any warranty regarding the demographic composition of Job Seekers applying to any particular job.

4. General Terms Disclaimer and Limit of Liability

4.1 No Warranty

This is our disclaimer of legal liability for the quality, safety, or reliability of our Services. LOCUMSBOOK AND ITS AFFILIATES MAKE NO REPRESENTATION OR WARRANTY ABOUT THE SERVICES, INCLUDING ANY REPRESENTATION THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, AND PROVIDE THE SERVICES (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, LOCUMSBOOK AND ITS AFFILIATES DISCLAIM ANY IMPLIED OR STATUTORY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF TITLE, ACCURACY OF DATA, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

4.2 Exclusion of Liability

These are the limits of legal liability we may have to you. TO THE FULLEST EXTENT PERMITTED BY LAW (AND UNLESS LOCUMSBOOK HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT OVERRIDES THIS CONTRACT), LOCUMSBOOK, INCLUDING ITS AFFILIATES, WILL NOT BE LIABLE IN CONNECTION WITH THIS CONTRACT FOR LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, REPUTATION (E.G., OFFENSIVE OR DEFAMATORY STATEMENTS), LOSS OF DATA (E.G., DOWN TIME OR LOSS, USE OF, OR CHANGES TO, YOUR INFORMATION OR CONTENT) OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES.

LOCUMSBOOK AND ITS AFFILIATES WILL NOT BE LIABLE TO YOU IN CONNECTION WITH THIS CONTRACT FOR ANY AMOUNT THAT EXCEEDS (A) THE TOTAL FEES PAID OR PAYABLE BY YOU TO LOCUMSBOOK FOR THE SERVICES DURING THE TERM OF THIS CONTRACT, IF ANY.

4.3 Basis of the Bargain; Exclusions

The limitations of liability in this Section 4 are part of the basis of the bargain between you and Locumsbook and shall apply to all claims of liability (e.g., warranty, tort, negligence, contract and law) even if Locumsbook or its affiliates has been told of the possibility of any such damage, and even if these remedies fail their essential purpose.

These limitations of liability do not apply to liability for death or personal injury or for fraud, gross negligence or intentional misconduct, or in cases of negligence where a material obligation has been breached, a material obligation being such which forms a prerequisite to our delivery of services and on which you may reasonably rely, but only to the extent that the damages were directly caused by the breach and were foreseeable upon conclusion of this Contract and to the extent that they are typical in the context of this Contract.

5. Termination

We can each end this Contract, but some rights and obligations survive. Both you and Locumsbook may terminate this Contract at any time with notice to the other. On termination, you lose the right to access or use the Services. The following shall survive termination:

Our rights to use and disclose your feedback;

Members and/or Visitors’ rights to further re-share content and information you shared through the Services;

Sections 4, 6, 7, and 8.2 of this Contract;*

You can close your account in the settings.

6. Governing Law and Dispute Resolution

In the unlikely event we end up in a legal dispute, you and Locumsbook agree to resolve it in Zimbabwean courts using Zimbabwean law. For those in Zimbabwe*: You and Locumsbook agree that the laws of the State of Zimbabwe, excluding its conflict of laws rules, shall exclusively govern any dispute relating to this Contract and/or the Services. You and Locumsbook both agree that all claims and disputes can be litigated only in the state courts in Harare, Zimbabwe, and you and Locumsbook each agree to personal jurisdiction in those courts.

7. General Terms

Here are some important details about the Contract.

If a court with authority over this Contract finds any part of it unenforceable, you and we agree that the court should modify the terms to make that part enforceable while still achieving its intent. If the court cannot do that, you and we agree to ask the court to remove that unenforceable part and still enforce the rest of this Contract.

This Contract (including additional terms that may be provided by us when you engage with a feature of the Services) is the only agreement between us regarding the Services and supersedes all prior agreements for the Services.

If we don't act to enforce a breach of this Contract, that does not mean that Locumsbook has waived its right to enforce this Contract. You may not assign or transfer this Contract (or your membership or use of Services) to anyone without our consent. However, you agree that Locumsbook may assign this Contract to its affiliates or a party that buys it without your consent. There are no third-party beneficiaries to this Contract. You agree that the only way to provide us legal notice is at the addresses provided in Section 10.

Identifying and Removing Fraudulent Accounts

Locumsbook uses automatic and manual means to identify and remove fraudulent accounts from the platforms. Locumsbook implements rules to automatically flag potentially risky accounts for review by its moderators, and proactively uses various tools and subject matter expertise to manually identify accounts that the automatic system may miss. Users can also proactively identify and report potentially fraudulent accounts and all other user-generated content on the platform, including job posts, company page content, and messages. These reports are reviewed by trained moderators.

Moderating User-Generated Content

Locumsbook also uses automatic and manual means to moderate user-generated content on the site, including implementing rules to automatically flag content that may not meet the standards set out in Locumsbook’s policies and these Terms of Service. Locumsbook also proactively reviews user-generated content for compliance with its policies and these Terms of Service. Additionally, users can report content they deem problematic to our admins see Contact. These reports are reviewed by trained moderators.

8. Locumsbook “Dos and Don’ts”

8.1. Dos

Locumsbook is a community of healthcare professionals. This list of “Dos and Don’ts” limit what you can and cannot do on our Services.

You agree that you will:

Comply with all applicable laws, including, without limitation, privacy laws, health laws, intellectual property laws, anti-spam laws, export control laws, tax laws, non-discriminatory laws ,labor laws and regulatory requirements;

Provide accurate information to us and keep it updated;

Use your real name on your profile; and

Use the Services in a professional manner.

8.2. Don’ts

You agree that you will not:

Create a false identity on Locumsbook, misrepresent your identity, create a Member profile for anyone other than yourself (a real person), or use or attempt to use another’s account; Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services; Override any security feature or bypass or circumvent any access controls or use limits of the Service (such as caps on keyword searches or profile views); Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties (such as search engines), without the consent of Locumsbook; Disclose information that you do not have the consent to disclose (such as confidential information of others (including your employer)); Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission, which they may give by posting under a Creative Commons license; Violate the intellectual property or other rights of Locumsbook, including, without limitation, (i) copying or distributing our learning videos or other materials or (ii) copying or distributing our technology, unless it is released under open source licenses; (iii) using the word “Locumsbook” or our logos in any business name, email, or URL without our consent; Post anything that contains software viruses, worms, or any other harmful code;

Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source; Imply or state that you are affiliated with or endorsed by Locumsbook without our express consent (e.g., representing yourself as an accredited Locumsbook technocraut); Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without Locumsbook’s consent; Deep-link to our Services for any purpose other than to promote your profile or a Group on our Services, without Locumsbook’s consent; Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages; Monitor the Services’ availability, performance or functionality for any competitive purpose; Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services; Overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services); Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or

9. Complaints procedure

Contact information for complaint about content provided by our Members.

We respect the intellectual property rights of others. We require that information posted by Members be accurate and not in violation of the intellectual property rights or other rights of third parties. We provide a policy and process for complaints concerning content posted by our Members.

If you are unhappy with a decision taken by Locumsbook in response to a notice of illegal content submitted by you via the reporting means or a decision taken by Locumsbook to restrict, remove or disable access to your content; to suspend or terminate the provision of service to you; or to suspend or terminate your account, you may submit a complaint within 3 months. The 3-month period begins on the day you are informed of the decision you are submitting a complaint about. Locumsbook requires you to include the following information in your complaint form: your email address, your reference number, and the specific reasons for your complaint, including why you disagree with Locumsbook’s decision.

Your Privacy Matters

Our mission is to connect healthcare professionals in a hub to allow them to be more productive by managing their locum jobs/jobs well. Central to this mission is our commitment to be transparent about the data we collect about you, how it is used and with whom it is shared.

This Privacy Policy applies when you use our Services (described below). We offer our users choices about the data we collect, use and share as described in this Privacy Policy, Cookie Policy, Settings and our Chatbot.

Introduction

We are an online platform for healthcare professionals. People use our Services to find and be found for healthcare job opportunities, to connect with others and find information. Our Privacy Policy applies to any Member or Visitor to our Services

Our registered users (“Members”) share their professional identities, engage with their network, and find career opportunities. Content and data on some of our Services is viewable to non-members (“Visitors”).

Services

This Privacy Policy, including our Cookie Policy applies to your use of our Services.

This Privacy Policy applies to Locumsbook.com, Locumsbook app(s), and services, including off-site Services, such as our ad services and ‘’Locumsbook” plugins, but excluding services that state that they are offered under a different privacy policy.

Data Controllers and Contracting Parties

Locumsbook Inc. will be the controller of your personal data provided to, or collected by or for, or processed in connection with, our Services.

As a Visitor or Member of our Services, the collection, use and sharing of your personal data is subject to this Privacy Policy and other documents referenced in this Privacy Policy, as well as updates.

Change

Changes to the Privacy Policy apply to your use of our Services after the “effective date.” Locumsbook (“we” or “us”) can modify this Privacy Policy, and if we make material changes to it, we will provide notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you may close your account.

You acknowledge that your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that the collection, use and sharing of your personal data is subject to the updated Privacy Policy, as of its effective date.

1. Data We Collect

1.1 Data You Provide To Us

You provide data to create an account with us.

Registration

To create an account you need to provide data including your name, email address and/or mobile number, a password, certificates, licenses and work experience. *

You create your Locumsbook profile (a complete profile helps you get the most from our Services).

Profile

You have choices about the information on your profile, such as your education, work experience, skills, photo, city or area and licenses. You don’t have to provide additional information on your profile; however, profile information helps you to get more from our Services, including helping employers/recruiters and other economic opportunities find you. It’s your choice whether to include sensitive information on your profile and to make that sensitive information public. Please do not post or add personal data to your profile that you would not want to be publicly available.

You give other data to us, such as by syncing your address book or calendar.

Posting and Uploading

We collect personal data from you when you provide, post or upload it to our Services, such as when you fill out a form, (e.g., with demographic data), or apply a locum job, do a medicine transfer, respond to a survey on our Services. If you opt to import your address book, we receive your contacts (including contact information your service provider(s) or app automatically added to your address book when you communicated with addresses or numbers not already in your list). This will keep growing your network by suggesting connections for you and others, and by providing information about events, e.g. times, places, attendees and contacts.

You don’t have to post or upload personal data; though if you don’t, it may limit your ability to grow and engage with your network over our Services.

1.2 Data From Others

Others may post or write about you.

Content and News

You and others may post content that includes information about you (as part of articles, reviews, medicine transfers) on our Services. Unless you opt-out, we collect public information about you, such as professional-related news and accomplishments (e.g. professional recognition, conference speakers, projects, etc.) and make it available as part of our Services (e.g. suggestions for your profile, or notifications to others of mentions in the news).

Others may sync their contacts or calendar with our Services.

Contact and Calendar Information

We receive personal data (including contact information) about you when others import or sync their contacts or calendar with our Services, associate their contacts with Member profiles, send messages using our Services (including invites or requests). If you or others opt-in to sync email accounts with our Services, we will also collect “email header” information that we can associate with Member profiles.

Customers and partners may provide data to us.

Partners

We receive personal data (e.g., your job title and work email address) about you when you use the services of our customers and partners, such as employers or prospective employers and applicant tracking systems providing us job application data.

Related Companies and Other Services

We receive data about you when you use some of the other services provided by us or our affiliates, if any.

Service Use

We log your visits and use of our Services, including mobile app(s).

We log usage data when you visit or otherwise use our Services, including our site, app and platform technology, such as when you view or click on content or ads (on or off our sites and apps), perform a search, install or update one of our mobile apps, share articles or apply for locum jobs. We use log-ins, cookies, device information and internet protocol (“IP”) addresses to identify you and log your use.

1.4 Cookies and Similar Technologies

We collect data through cookies and similar technologies.

As further described in our Cookie Policy, we use cookies and similar technologies (e.g., pixels and ad tags) to collect data (e.g., device IDs) to recognize you and your device(s) on, off and across different services and devices where you have engaged with our Services. We also allow some others to use cookies as described in our Cookie Policy. We also collect (or rely on others who collect) information about your device where you have not engaged with our Services (e.g., ad ID, IP address, operating system and browser information) so we can provide our Members with relevant ads and better understand their effectiveness. You can opt out from our use of data from cookies and similar technologies that track your behavior on the sites of others for ad targeting and other ad-related purposes.

1.5 Your Device and Location

We receive data from your devices and networks, including location data.

When you visit or leave our Services (including some plugins and our cookies or similar technology on the sites of others), we receive the URL of both the site you came from and the one you go to and the time of your visit. We also get information about your network and device (e.g., IP address, proxy server, operating system, web browser and add-ons, device identifier and features, cookie IDs and/or ISP, or your mobile carrier). If you use our Services from a mobile device, that device will send us data about your location based on your phone settings. We will ask you to opt-in before we use GPS or other tools to identify your precise location.

1.6 Messages

If you communicate through our Services, we learn about that.

We collect information about you when you send, receive, or engage with messages in connection with our Services. For example, if you get a Locumsbook link request, we track whether you have acted on it and will send you reminders. We also use automatic scanning technology on messages to support and protect our site. For example, we use this technology to suggest possible responses to messages and to manage or block content that violates our User Agreement from our Services.

1.7 Workplace and School Provided Information

When your organization (e.g., employer) buys a premium Service for you to use, if any , they give us data about you.

Others buying our Services for your use, such as your employer, provide us with personal data about you and your eligibility to use the Services that they purchase for use by their employees. *

1.8 Sites and Services of Others

We get data when you visit sites that include our ads, cookies or some of our plugins or when you log-in to others’ services with your Locumsbook account.

We receive information about your visits and interaction with services provided by others when you log-in with Locumsbook or visit others’ services that include some of our plugins or our ads, cookies or similar technologies

We are improving our Services, which means we get new data and create new ways to use data.

Our Services are dynamic, and we often introduce new features, which may require the collection of new information. If we collect materially different personal data or materially change how we collect, use or share your data, we will notify you and may also modify this Privacy Policy.

2. How We Use Your Data

We use your data to provide, support, personalize and develop our Services.

How we use your personal data will depend on which Services you use, how you use those Services and the choices you make in your settings. We use the data that we have about you to provide and personalize our Services, including with the help of automated systems and inferences we make, so that our Services (including ads) can be more relevant and useful to you and others.

2.1 Services

Our Services help you connect with others, find and be found for work and business opportunities, stay informed, get training and be more productive.

We use your data to authorize access to our Services and honor your settings.

Stay Connected

Our Services allow you to stay in touch and up to date with colleagues, partners, and other professional contacts. To do so, you can “link” with the professionals who you choose, and who also wish to “link” with you. Subject to your and their settings, when you link with other Members, you will be able to search each others’ connections in order to exchange professional opportunities.

We use data about you (such as your profile, profiles you have viewed or data provided through address book uploads) to help others find your profile, suggest links for you and others (e.g. Members who share your contacts or locum job experiences) and enable you to invite others to become a Member and connect with you. You can also opt-in to allow us to use your precise location or proximity to others for certain tasks.

It is your choice whether to invite someone to our Services, send a link request, or allow another Member to become your connection. When you invite someone to link with you, your invitation will include your network and basic profile information (e.g., name, profile photo, job title, region). We will send invitation reminders to the person you invited. You can choose whether or not to share your own list of links with your connections.

Visitors have choices about how we use their data.

Stay Informed

Our Services allow you to stay informed about news, events and ideas regarding professional topics you care about, and from professionals you respect. Our Services also allow you to improve your professional skills. We use the data we have about you (e.g., data you provide, data we collect from your engagement with our Services and inferences we make from the data we have about you), to personalize our Services for you, such as by recommending or ranking relevant content and conversations on our Services. We also use the data we have about you to suggest skills you could add to your profile and skills that you might need to pursue your next locum job opportunity. So, if you let us know that you are interested in a new skill, we will use this information to personalize content in your feed, suggest that you follow certain members on our site, or suggest related learning content to help you towards that new skill. We use your content, activity and other data, including your name and photo, to provide notices to your network and others. For example, subject to your settings, we may notify others that you have updated your profile, posted content, took a social action, used a feature, made new connections or were mentioned in the news.

Career

Our Services allow you to explore careers, evaluate educational opportunities, and seek out, and be found for, career opportunities. Your profile can be found by those looking to hire or be hired by you. We will use your data to recommend locum jobs, show you and others relevant professional contacts (e.g., who work at a company, in an industry, function or location). We will use your data to recommend jobs to you and you to employers. We may use automated systems to provide content and recommendations to help make our Services more relevant to our Members, Visitors and customers. Keeping your profile accurate and up-to-date may help you better connect to others and to opportunities through our Services.

Productivity

Our Services allow you to collaborate with colleagues, search for employers, partners and others to do business with.

2.2 Premium Services

There are no Premium services for now.

2.3 Communications

We contact you and enable communications between Members. We offer settings to control what messages you receive and how often you receive some types of messages.

We will contact you through email, mobile phone, notices posted on our website or app(s), messages to your Locumsbook inbox, and other ways through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. We also send messages about how to use our Services, network updates, reminders, locum job suggestions and promotional messages from us and our partners. You may change your communication preferences at any time. Please be aware that you cannot opt out of receiving service messages from us, including security and legal notices.

We also enable communications between you and others through our Services, including for example invitations, and messages between connections.

2.4 Advertising

We serve you tailored ads both on and off our Services. We offer you choices regarding personalized ads, but you cannot opt-out of seeing other ads.

We target (and measure the performance of) ads to Members, Visitors and others both on and off our Services directly or through a variety of partners, using the following data, whether separately or combined:

Data from advertising technologies on and off our Services, pixels, ad tags, cookies, and device identifiers; Member-provided information (e.g., profile, contact information, title and industry); Data from your use of our Services (e.g., search history, feed, content you read, who you follow or is following you, links, page visits, videos you watch, clicking on an ad, etc.), including as described in Section 1.3; Information from advertising partners, vendors and publishers ; and Information inferred from data described above (e.g., using job titles from a profile to infer industry, seniority, and compensation bracket; using graduation dates to infer age or using first names or pronoun usage to infer gender; using your feed activity to infer your interests; or using device data to recognize you as a Member). We will show you ads called sponsored content which look similar to non-sponsored content, except that they are labeled as advertising (e.g., as “ad” or “sponsored”). If you take a social action (such as like, comment or share) on these ads, your action is associated with your name and viewable by others, including the advertiser. Subject to your settings, if you take a social action on the Locumsbook Services, that action may be mentioned with related ads.

Ad Choices

We adhere to self-regulatory principles for interest-based advertising and participate in industry opt-outs from such ads. This does not opt you out of receiving advertising; you will continue to get other ads by advertisers not listed with these self regulatory tools. You can also opt-out specifically from our uses of certain categories of data to show you more relevant ads. For Visitors, the setting is here.

Info to Ad Providers

We do not share your personal data with any third-party advertisers or ad networks except for: (i) hashed IDs or device identifiers (to the extent they are personal data in some countries); (ii) with your separate permission (e.g., in a lead generation form) or (iii) data already visible to any users of the Services (e.g., profile). However, if you view or click on an ad on or off our Services, the ad provider will get a signal that someone visited the page that displayed the ad, and they may, through the use of mechanisms such as cookies, determine it is you. Advertising partners can associate personal data collected by the advertiser directly from you with hashed IDs or device identifiers received from us. In such instances, we seek to contractually require such advertising partners to obtain your explicit, opt-in consent before doing so.

2.5 Marketing

We promote our Services to you and others.

In addition to advertising our Services, we use Members’ data and content for invitations and communications promoting membership and network growth, engagement and our Services, such as by showing your connections that you have used a feature on our Services.

2.6 Developing Services and Research

We develop our Services and conduct research.

Service Development

We use data, including public feedback, to conduct research and development for our Services in order to provide you and others with a better, more intuitive and personalized experience, drive membership growth and engagement on our Services, and help connect professionals to each other and to economic opportunity.

Other Research

We seek to create economic opportunity for Members of the healthcare workforce and to help them be more productive We use the personal data available to us to research social, economic and workplace trends, such as locum jobs availability and skills needed for these jobs and policies that help bridge the gap in various industries and geographic areas. In some cases, we work with trusted third parties to perform this research, under controls that are designed to protect your privacy. We publish or allow others to publish economic insights, presented as aggregated data rather than personal data.

Surveys

Polls and surveys are conducted by us and others through our Services. You are not obligated to respond to polls or surveys, and you have choices about the information you provide. You may opt-out of survey invitations.

2.7 Customer Support

We use data to help you and fix problems.

We use data (which can include your communications) to investigate, respond to and resolve complaints and for Service issues (e.g., bugs).

2.8 Insights That Do Not Identify You

We use data to generate insights that do not identify you.

We use your data to produce and share insights that do not identify you. For example, we may use your data to generate statistics about our members, their profession or industry, to calculate ad impressions served or clicked on, or to publish visitor demographics for a Service or create demographic workforce insights.

2.9 Security and Investigations

We use data for security, fraud prevention and investigations.

We use your data (including your communications) for security purposes or to prevent or investigate possible fraud or other violations of our User Agreement and/or attempts to harm our Members, Visitors or others.

3. How We Share Information

3.1 Our Services

Any data that you include on your profile and any content you post on our Services will be seen by others, consistent with your settings. Profile

Your profile is fully visible to all Members and customers of our Services. Subject to your settings, it can also be visible to others on or off of our Services (e.g., Visitors to our Services or users of third- party search engines).**

3.2 Others’ Services

You may link your account with others’ services so that they can look up your contacts’ profiles. Excerpts from your profile will also appear on the services of others. Subject to your settings, other services may look up your profile. When you opt to link your account with other services, personal data will become available to them. The sharing and use of that personal data will be described in, or linked to, a consent screen when you opt to link the accounts. *

3.3 Related Services

We share your data across our different Services and Locumsbook affiliates, if any. We will share your personal data with our affiliates to provide and develop our Services. We may combine information internally across the different Services covered by this Privacy Policy to help our Services be more relevant and useful to you and others. For example, we may personalize your feed or job recommendations based on your learning history.

3.4 Service Providers

We may use others to help us with our Services.

If you choose to close your Locumsbook account, your personal data will generally stop being visible to others on our Services within 24 hours. We generally delete closed account information within 30 days of account closure, except as noted below.

We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse (e.g., if we have restricted your account for breach of our Policies, enforce our User Agreement, or fulfill your request to "unsubscribe" from further messages from us. We will retain de-personalized information after your account has been closed.

Information you have shared with others will remain visible after you close your account or delete the information from your own profile or mailbox, and we do not control data that other Members have copied out of our Services. Groups content and ratings or review content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others (e.g., search engine results) until they refresh their cache.
